1. Contractual Partner and Scope

These Terms of Service ("Terms") govern your access to and use of the Wissero website, mobile applications, browser extensions, and any related services (collectively, the "Service").

(Hereinafter referred to as "Wissero", "we", "us", or "our")

By registering for and using the Service, you confirm that you are at least 18 years old (or have the explicit consent of a legal guardian) and that you accept and will comply with these Terms. Institutional agreements may permit access by users under 18 under the supervision and responsibility of the contracting institution.

2. Description of the Service and Third-Party Integrations

Wissero is an AI-first adaptive language learning platform providing personalized educational content, quizzes, AI tutoring, and progress tracking.

To deliver these features, Wissero integrates with specialized third-party service providers, including but not limited to:

• External AI service providers (which may include, among others, Google Gemini or other providers) for processing text and StudyLab materials
• Microsoft Azure Speech Assessment for pronunciation evaluation
• Langfuse for AI tracing and pedagogical improvement
• Google Tag Manager, Google Analytics, and Hotjar for platform analytics and optimization
• DodoPayment for payment processing

By using the Service, you acknowledge that your inputs, voice recordings, and uploaded documents will be processed by these third-party infrastructure providers in accordance with our Privacy Policy.

3. Early Access and Warranty Disclaimer

Wissero is currently in an early experimental ("beta") stage. The Service is supplied "as is" and "as available," without any guarantee of continuous availability, accuracy, or fitness for a particular purpose.

References to UNIcert® and other exam formats describe preparation simulations only. Wissero is not an official certifying body or examination authority.

No Pass Guarantee
Wissero does not guarantee that any learner will pass any language exam, assessment, or certification.

AI Outputs
AI-generated content (including tutoring responses and StudyLab extracted topics) may occasionally be inaccurate. You should not rely solely on AI-generated content for critical academic or professional decisions.

Service Continuity
Wissero is not liable for service interruptions caused by third-party infrastructure failures, force majeure events, or circumstances beyond our reasonable control, including but not limited to external AI API outages, hosting provider failures, and natural disasters.

4. Accounts, User-Generated Content, and StudyLab

A. User Rights and Licensing
Content you upload, including documents (e.g., PDFs for StudyLab), text, and ratings ("User Content"), remains your property. By uploading User Content, you grant Wissero a worldwide, non-exclusive, royalty-free license to store, host, display, process (including via our third-party AI service providers as described in Section 2), edit, and analyze that content for the purpose of operating the Service.

B. StudyLab: Upload, Analysis, and Sharing
StudyLab allows you to upload materials, optionally analyze them using an external AI service, and organize them into Study Spaces. These actions are distinct and user-initiated:
• Upload: By uploading a file, you confirm you own the material or have the right to upload and process it with AI. Your confirmation is recorded to your account.
• Analysis: Triggering AI analysis sends your uploaded material to an external AI service provider for processing. You initiate this step explicitly.
• Sharing (shared-private spaces): When you share a Study Space with specific individuals, you authorize those individuals to access your uploaded source materials in read-only mode. You confirm you have the right to grant such access.
• Public spaces: When you make a Study Space public, you explicitly authorize Wissero to generate and display derivative educational materials (such as topics, vocabulary lists, and practice exercises) based on your uploaded content. Raw uploaded materials are not accessible to other users in public spaces.

Shared access to a Study Space is revoked when the owner deletes the space or their account.

C. Copyright and Lawfulness of Uploads
You represent and warrant that you own or possess the necessary licenses and rights to upload, process with AI, and share the materials you add to StudyLab. You strictly agree not to upload copyrighted materials for which you do not have explicit authorization to use in this manner. Wissero assumes no responsibility for the lawfulness of the learning content uploaded by users.

Upon your first upload, Wissero presents an in-product confirmation dialog which is recorded to your account with a timestamp, referencing these Terms. This record constitutes evidence of your acknowledgment of your obligations under this section.

If you breach these Terms by uploading materials for which you do not hold the necessary rights, and Wissero consequently faces a claim, you shall indemnify and hold Wissero harmless from and against all resulting costs, including reasonable legal defense fees (see also Section 10).

5. Conclusion of Contract, Free Access, and Purchasing Process

A. Free Usage Contract
Upon successfully registering an account, a free usage contract (Nutzungsvertrag) is concluded between you and Wissero. This grants you limited access to introductory platform features, designated free units, or specific trial phases.

B. Purchasing Paid Content
Wissero operates on a one-time payment model; we do not offer recurring subscriptions. To access advanced features, complete courses, or scheduled classes, you must make a one-time purchase. The presentation of paid content does not constitute a legally binding offer by Wissero, but rather an invitation for you to submit a binding offer to purchase.
• Course Access: A one-time purchase of a standard course grants you unlimited, lifetime access to that specific course material for as long as the Service remains operational. This access is strictly personal and licensed to a single user only. Sharing your account or credentials to allow others to benefit from your purchased access is prohibited and constitutes a material breach of these Terms, regardless of whether payment was the motivation.
• Class Access: A one-time purchase of a scheduled or live class grants you access strictly for the official, predefined duration of that specific class.

C. The Checkout Procedure
You select the desired course or class and are directed to our payment provider (DodoPayment). You submit a binding offer by clicking the final order button (e.g., "Zahlungspflichtig bestellen" or "Buy Now"). The paid contract is officially concluded when Wissero provides access to the unlocked content and sends an electronic order confirmation.

6. Statutory Right of Withdrawal (Widerrufsbelehrung)

If you are a consumer under EU/German law, you have a statutory 14-day right of withdrawal from the date of contract conclusion, without giving any reason.

If you withdraw within the allowed timeframe, we shall reimburse all payments received without undue delay, no later than 14 days from the day we are informed of your decision, using the same payment method as the initial transaction.

Please note: where you have substantially accessed or consumed paid digital content, German law permits us to calculate a proportional reduction in any refund to reflect the value already delivered.

7. Account Deletion, Cancellations, and Refunds

A. Account Deletion
You may delete your account at any time via your account settings or by contacting us at contact. Deleting your account will permanently erase your learning progress, Study Spaces, and access to previously purchased courses or classes. Sub-processor data retention following deletion is governed by our Privacy Policy. Account deletion does not entitle you to a refund for past purchases.

B. Canceling Class Enrollments
If you have enrolled in a scheduled class and wish to cancel before it begins, submit a request via contact or email hello@wissero.com. Refunds for pre-class cancellations are handled on a case-by-case basis depending on timing relative to the class start date.

C. Refund Requests
Refunds are governed by the Statutory Right of Withdrawal (Section 6) and our digital goods policy. Because we provide free units to allow evaluation before purchase, refund requests for paid courses where content has been substantially accessed will be assessed proportionally. If you believe you are entitled to a refund due to a billing error or technical failure on our part, submit a request via contact or the platform UI.

8. Copyright Infringement and Takedown Policy

If you believe that content hosted on our Service infringes upon your copyright, please notify us immediately via contact or at hello@wissero.com. Your notice must include:
• A signature (electronic or physical) of the rights holder or authorized representative
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on our Service
• Your contact information
• A statement of good faith belief that the use is not authorized by the rights holder

Wissero reserves the right to remove allegedly infringing content promptly upon receipt of a valid notice and to terminate the accounts of repeat infringers.

9. Institutional Users (B2B / Language Centers)

If you are accessing the Service through an agreement between Wissero and an educational institution or private language center ("Institution"), your use is also subject to the policies of that Institution. In the event of a conflict between these Terms and a master agreement executed between Wissero and the Institution, the master agreement shall prevail regarding data retention, account administration, and service provision.

10. Limitation of Liability

Unlimited liability: Wissero is liable without limitation for intent and gross negligence, for injuries to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
Ordinary negligence: In the event of slight negligence, we are liable only for breach of an essential contractual duty ("cardinal duty"), and then only for foreseeable, typical damage.
Data loss: Liability for loss of data is limited to the typical recovery expenses that would have arisen if you had made regular backup copies.
Indemnification: If you breach these Terms, upload materials for which you do not hold the necessary rights, or violate a third party's rights, and Wissero consequently faces a claim, you shall indemnify and hold Wissero harmless from and against all resulting costs, including reasonable legal defense fees (see also Section 10).

11. Termination, Anti-Sharing Policy, and House Rules

A. Strict Prohibition on Account Sharing
Wissero accounts are strictly personal and licensed for single-user use only. The lifetime access granted with a one-time course purchase is a benefit extended to the individual purchaser, not a household, group, or organization. You are expressly prohibited from sharing your login credentials, session tokens, or any means of account access with third parties, whether or not payment is involved. If our systems detect concurrent logins from different locations, suspicious IP switching, device fingerprint anomalies, or any usage patterns indicating that multiple individuals are accessing a single account, Wissero reserves the right to immediately and permanently ban the offending account. In such cases, the lifetime access benefit is forfeited with no entitlement to a refund.

B. House Rules and Enforcement
In the event of a ban due to account sharing, copyright infringement, or any other material breach of these Terms, your access to the platform will be revoked instantly. In such cases, you forfeit your right to access any previously purchased courses or classes, and no refunds will be issued. Wissero reserves the right to review, modify, or permanently delete any User Content, and to suspend or terminate accounts at its sole discretion without prior notice if these Terms or applicable laws are violated.

12. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§36 VSBG).

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, the mandatory statutory places of jurisdiction apply.
For merchants and business users (Kaufleute), the exclusive place of jurisdiction is Bayreuth, Germany.

14. Severability

If any provision of these Terms is held invalid, the remaining provisions remain in full force. An invalid clause shall be replaced by a valid provision that comes closest to the economic and legal purpose of the invalid one.

15. Changes to These Terms

Wissero reserves the right to update these Terms at any time. We will notify registered users of material changes via email or a prominent in-platform notice at least 14 days before changes take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
